MUTUAL CONSENT DIVORCE
In Mutual Consent Divorce, both the parties’ husband and wife mutually
agree to terminate their marital relationship legally and separate.
This saves the parties from cumbersome litigation compared to contested
divorce procedure.
It is also simple to file for a mutual consent divorce. Under Section- 13B
of the Hindu Marriage Act, 1955, a provision has been provided for mutual
consent divorce wherein certain conditions must be satisfied by the parties
to get a divorce. In addition, Section- 28 of the Special Marriage Act, 1954
and Section- 10A of the Divorce Act, 1869, also cater to mutual consent divorce.

CONTESTED DIVORCE
In Contested divorces one party either husband or wife proceed towards the
legal recourse for divorce even though the counter party is not in favor
of the same and resisting having a divorce between them. At time there is
a situation where both parties agree for separation but they have some
disagreements regarding issues like custody of children, alimony or maintenance,
property division etc. A contested divorce is mainly driven on the grounds
available to the parties of a marriage where the parties have to prove at
least one such ground in the court of law.
