Restitution of Conjugal Rights is a remedy provided in Section 9 of
Hindu Marriage Act, 1955, which could be used by the deserted spouse
against the other, but under no condition the court can force the erring
spouse to consummate the marriage. The aggrieved party when abandoned by
the spouse without any reasonable cause, a legal right to file petition in
the Matrimonial Court for RCR can be filed.
If the spouse of the aggrieved party refuses to cohabitation as ordered by Court,
then the court can attach property and the decision can be appealed before the
High Court and the Supreme Court.
